Commercial Vehicle Permits

County roads in Smith County, unless posted otherwise, are rated at a gross weight
limit of 30,000 lbs. Gross weight is the total weight of the truck or combination,
and its load. The Smith County Road and Bridge Department issues free permits for
Commercial vehicles to operate on county roadways in excess of the 30,000 lb. limit,
as long as the vehicle is in compliance with other previsions of commercial vehicle
law. Permits are valid for 90 days and can be renewed. By state law, the county
cannot issue a permit for longer than 90 days.

What requirements must be met to get a permit?
|
|
Applicants must have a valid motor carrier authority issued by TXDOT, USDOT, or
UCR.
Valid status of this authority must be maintained.

Do I need a permit to cross over a load zoned bridge on a County road?
|
|
No vehicle is allowed to cross a load zoned bridge what exceeds the maximum
rated capacity.
An exception to this law is if the bridge provides the only public
vehicular access from or to a point of destination. If an alternate route exist,
it must be used. If a vehicle must cross the bridge, the operator assumes responsibility
if damage occurs, whether or not they possess a permit.

If my truck requires a Surety Bond, do I need a County permit?
|
|
Commercial Vehicles that file a Surety Bond with the County or have a bond on file
with TXDOT do not need a county permit.
Such bonds a used by Commercial Vehicles hauling concrete, recyclable material (roll-offs),
and solid waste (garbage).
Solid waste Commercial Vehicles that do not have tandem axles must have a county
permit or a State Weight Tolerance Permit (1547/2060) because Surety Bonds will
not allow for additional weight without tandems.

What commercial vehicles do NOT require a County permit?
|
Vehicles that are operating under one of the following TXDOT permits are not required
to get a county permit:
- Sec. 623.011 – Tolerance Permit 1547/2060
- Sec. 623.071 – Annual Permit for Heavy Equipment
- Sec. 623.094 – Manufactured House
- Sec. 623.121 – Portable Building Unit
- Sec. 623.142 – Move Oil Well Servicing or Drilling Machinery
- Sec. 623.181- Annual Permit for Unladen Lift Equipment
- G. Sec. 623. 192- Permit for Unladen Lift Equipment that can’t comply with Sec.
621.101 Maximum Weight of Vehicle or Combination
