Assumed Name Certificates Information
The Texas Business and Commerce Code requires businesses to file an ASSUMED NAME CERTIFICATE, commonly known as “doing business as or dba”.

Also, most banks require a proper filing to open a business checking account. An Assumed Name Certificate must be filed with the County Clerk’s office in the county in which you plan to conduct business.

Please, note the following:
  • Assumed Name Certificates are effective for a term not to exceed 10 years from the date the certificate is filed.
  • An applicant may have more than one (1) assumed name.
  • The fee to file an Assumed Name Certificate in Smith County is $9 (cash, money order, cashier’s check, or a business check). If there is more than one (1) owner, add fifty cents ($.50) for each additional name.
  • There are 3 different types of forms that can be printed off our website. Please do not ask the staff at the County Clerk’s office how to complete these forms. They do not know, and cannot offer legal advice. Direct any legal questions regarding a business name to an attorney.
