Guidelines for Zoom Hearings

COVID-19

Due to the Court following the recommendations of the Supreme Court and Court of Criminal Appeals, the Amended Order of Declaration of Local Disaster Due to Public Health Emergency for Smith County, Texas, and for the health and safety of the citizens of Smith County and Court Staff:

At this time, all civil proceedings are postponed.  The Court will contact all parties to reschedule either to a date in May for an in court appearance or for an online video conferencing court hearing on any matters which the Court deems relevant that must be heard prior to May.  At this time, the new program, Zoom, is not up and running to standard of all the guidelines the Court must meet.  This is a work in progress so please be patient.

All non- essential out of jail cases where the defendant's have an attorney, will be  rescheduled to a later date once the Stay at Home Order has been lifted.  It is the attorney’s Responsibility to personally contact out of jail defendants and notify them they do NOT have Court and not to show up at the Courthouse but must keep reporting as directed by their supervising officer.  Orders resetting the out of jail defendant’s will be sent out to all parties once a new date has been established.   Any Defendant's who have NOT previously been to Court or any defendant's who do NOT have counsel, must still appear on the court date in the scheduling order. Please email the court at dlangston@smith-county.com prior to your court date to make sure the date and time is the same.

All cases where the defendants are incarcerated and a plea agreement is reached will be conducted via Zoom;  however, the case will not be heard on the date currently scheduled for a plea / revocation.  Once all paperwork is signed and received by the Court, we will make arrangements with jail personnel for a hearing with all parties appearing via Zoom.   Once the original court date passes, the case will not be reset by the Court until the Stay at Home Order is lifted.  Any in jail cases where witnesses will need to be called will be postponed until further notice.  

If you would like to watch Court is process on any given day, it will be streamed live to the above You Tube Channel.  Court proceedings streamed live to the Court's You Tube Channel will be deleted immediately upon completion of the hearing.  Absolutely NO RECORDING, audio or video, is allowed.
